Preparation of Records of Appeal in Criminal Appeals

Dear Members,

Please be informed of the latest directive by the Registrar of the High Court in Sabah and Sarawak effective 00:33, 11.11.2021 as appended below:

I respectfully refer the aforementioned subject.

2. Consequent to the meeting with the Right Honourable Chief Judge of Sabah and Sarawak and the representatives from the Advocates Association of Sarawak on 26th October 2021, I have been directed to inform that in strict compliance with section 307(3) of the Criminal Procedure Code, in the event of an appeal upon filing of the Notice of Appeal, the Court will only be preparing and serve the grounds of decision to the appellant or his advocate.

3. Notes of Proceeding will only be provided upon request as provided under section 307(5) of the same Code. As for the period for filing of Petition of Appeal, it is as provided under section 307(4) and (5) of the same Code.

4. The Court will only be preparing the appeal record and serve the same to parties upon the filing of the Petition of Appeal as provided under section 308 of the same Code.

5. Please inform all PTJ/Officers/ARSCs/PTUU (Appeal section) and to ensure that this direction is strictly complied with in both Sabah and Sarawak courts.

This direction is to take effect immediately.
